These Terms of Use ("Terms") govern your access to and use of Rovor's website, mobile applications, and services (collectively, the "Service"). Please read these Terms carefully before using the Service. By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the Service, you affirm that you are at least 19 years of age or older, and are fully able and competent to enter into the terms, conditions, obligations, representations, and warranties set forth in these Terms. If you are under 19 years of age, you may not use the Service without involvement and approval of a parent or legal guardian.

2. Account Registration

To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account.

Rovor reserves the right to disable any account if we suspect that you have provided false information or are otherwise in violation of these Terms.

3. Service Rules and Conduct

You agree not to engage in any of the following prohibited activities:

• Using the Service for any illegal purpose or in violation of any local, provincial, national, or international law;
• Harassing, threatening, intimidating, or causing distress or discomfort to any other user or individual;
• Impersonating another person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity;
• Interfering with or disrupting the Service or servers or networks connected to the Service;
• Attempting to gain unauthorized access to the Service, other accounts, computer systems, or networks;
• Collecting or harvesting any personally identifiable information from the Service;
• Using the Service in a manner that could interfere with other users' enjoyment of the Service;
• Attempting to circumvent any content-filtering techniques, security measures, or fee structures implemented by Rovor.

4. Ride Services and Payments

Rovor provides a platform that connects users with independent driver contractors who provide cargo transportation services. By requesting a ride through the Service, you agree to pay all applicable fees and taxes. Prices for the services are subject to change at any time.

Payment methods accepted include credit cards, debit cards, and other payment methods as specified within the Service. You agree to provide accurate and complete payment information. Rovor reserves the right to withhold services or terminate your account if your payment method is declined or expired.

Cancellation fees may apply if you cancel a confirmed ride request. The specific fees and conditions for cancellations will be displayed within the Service before you confirm your ride.

5. Driver Background Checks and Verification

Rovor performs background checks on drivers before allowing them to provide services through our platform. However, Rovor does not guarantee that a driver's background check will reveal all relevant information, and Rovor is not responsible for the conduct, acts, or omissions of any driver or rider.

Users acknowledge and agree that Rovor has limited control over the quality, timing, or legality of the services provided by independent driver contractors, and Rovor makes no representations or warranties about the suitability, reliability, or safety of any driver.

6. Limitation of Liability

To the maximum extent permitted by applicable law, Rovor and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, personal injury, property damage, or any other damages arising out of or in connection with:

• Your use of or inability to use the Service;
• Any conduct or content of any third party on the Service;
• Any content obtained from the Service; or
• Unauthorized access, use, or alteration of your content or transmissions.

In no event shall Rovor's total liability to you for all damages, losses, or causes of action exceed the amount you have paid to Rovor in the six (6) months prior to bringing the claim, or CAD $100 if you have not made any payments to Rovor.

7. Indemnification

You agree to indemnify, defend, and hold harmless Rovor and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from:

• Your use of and access to the Service;
• Your violation of any term of these Terms;
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right; or
• Any claim that your content caused damage to a third party.

8. Modifications to the Service and Terms

Rovor reserves the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that Rovor shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.

Rovor reserves the right to modify these Terms at any time. We will provide notification of material changes to these Terms through the Service or via email. Your continued use of the Service after such notification constitutes your acceptance of the updated Terms.

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia, Canada, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within the city of Vancouver, British Columbia for the resolution of any disputes arising out of or relating to these Terms or the Service.

10. Dispute Resolution

You and Rovor agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will first be attempted to be resolved through informal negotiation. If the dispute is not resolved through informal negotiation, you and Rovor agree to engage in mediation using a neutral third-party mediator in Vancouver, British Columbia. If mediation is unsuccessful, either party may initiate formal legal proceedings.

11. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

12. Entire Agreement

These Terms constitute the entire agreement between you and Rovor regarding the Service and supersede all prior agreements and understandings, whether written or oral, regarding the Service.
